On most international platforms, a simple click on &#8220;I am 18 or older&#8221; was sufficient. This could change. A ministerial draft to amend the Audiovisual Media Services Act (AMD-G) and the KommAustria Act, which went into consultation at the end of July 2026, aims to significantly tighten existing youth protection rules \u2014 affecting providers of pornographic video-sharing platforms that want to continue offering their services in Austria.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mandatory Age Verification for All Planned<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The draft builds on existing requirements: content that &#8220;primarily consists of unreflective depictions of sexual acts&#8221; must already be inaccessible to minors and subject to &#8220;effective access control through age verification.&#8221; What is new is that the requirements for this verification are to be massively increased and specified. In the future, a simple self-declaration button will no longer suffice. Platform providers must implement an age verification system (AVS) that, according to the state of the art, is among the most data-minimizing methods available. It consists of a registration component (age capture) and a presentation component.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Key technical requirements include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Strict separation between the platform and the verification provider,<\/li>\n\n\n\n<li>Non-observability and non-traceability of the proofs,<\/li>\n\n\n\n<li>Data minimization and selective disclosure (the platform only receives the age predicate \u2014 i.e., information whether the required age limit is met),<\/li>\n\n\n\n<li>Exclusion of centralized usage logging, and<\/li>\n\n\n\n<li>Interoperability via open standards.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The age determination itself must be &#8220;reliable&#8221; and meet a standard of care equivalent to identity checks in the financial sector (FM-GwG and Online-IDV). For user accounts, verification usually only needs to be done once.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">&#8220;ID Austria&#8221; as Proof<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">One of the options mentioned is ID Austria, the Austrian government&#8217;s electronic identity proof \u2014 the successor to the former mobile phone signature and citizen card. Users can securely identify themselves online and use digital services; registration typically occurs via a linked app or an authentication factor. In the planned system, ID Austria (or a private provider) will operate under a double-blind model: the verification service does not know for which platform the proof is provided, and the erotic site only learns whether the user has reached the age limit (here 18 years) \u2014 without any further personal data.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Consequences for Adult Providers<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Providers wishing to continue offering their services in Austria will face concrete consequences: they must integrate a compliant age verification solution or connect to a recognized third-party provider. Violations may result in administrative fines; for very large online platforms (as defined by the Digital Services Act), these can amount to up to 6 percent of their global annual turnover. The draft also foresees procedures allowing the regulatory authority (KommAustria) to take action against providers established in other EU member states or outside the EU that target Austrian users \u2014 including delivery via the DSA contact point and, if necessary, enforcement measures against debtors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The law is scheduled to come into force on January 1, 2027; platform providers have until March 31, 2027, at the latest to implement the age verification requirements. However, it is by no means certain whether and in what form the draft will survive the parliamentary process \u2014 the consultation period runs until September 2026, and it is a ministerial draft.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is worth mentioning that the same draft also aims to regulate access for under-14s to video-sharing platforms with certain &#8220;addictive&#8221; features (recommendation systems, endless scrolling, push notifications, etc.).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Controversial and Risky<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The plans are far from undisputed. The fundamental rights NGO epicenter.works explicitly warns that such a legal tightening &#8220;would involve enormous risks of exclusion, discrimination, surveillance, and freedom of expression.&#8221; Once age verification is linked to identity proofs, the anonymous and free internet would be history; a future government could control access and exclude certain groups of people.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Looking to Germany: Strict Rules, Difficult Enforcement<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">For comparison: Germany has had significantly stricter regulations for many years. The Youth Media Protection State Treaty (JMStV) requires closed user groups with effective age verification for pornographic offerings. German authorities and courts have been struggling for years with international providers like Pornhub or YouPorn \u2014 with very limited success so far. There have been blocking orders and court confirmations but also setbacks and ongoing technical and legal hurdles in enforcement against services based outside Germany. Many large portals have remained largely accessible or have circumvented restrictions.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">ECJ Ruling and National Leeway<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Also relevant is a June 2026 ruling by the European Court of Justice (joined cases C-188\/24 and C-190\/24) on French age verification rules for pornographic offerings (<a href=\"https:\/\/caszin.com\/en\/ecj-judgment-stronger-national-powers-for-age-verification-but-no-blank-check-for-blocking-orders\/\">CASZIN reported)<\/a>.The Court clarified that national youth protection measures \u2014 even against providers established in other EU states \u2014 can be permissible under certain conditions because they are justified by public order and the protection of minors. Although they restrict the free movement of services, they can be proportionate. Conditions include that the country of origin is first requested to take measures itself and that the Commission and the country of origin are notified. The ruling strengthens national scope for action but does not mean unilateral moves within the EU are automatically unproblematic or free from further legal and practical hurdles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For the adult industry, this means: those who do not want to lose the Austrian market must prepare for technical and organizational adjustments. At the same time, it remains to be seen whether the draft will become law in its current form and how practical enforcement \u2014 especially against large international players \u2014 will actually succeed.
